Access to the Platform (defined below) is subject to Terms of Service located at the Platform (“Terms”), and capitalized terms used and not defined in this Privacy Policy, shall have the same meaning ascribed to them in the Terms.

This privacy policy (“Privacy Policy”) governs the privacy terms of the Platform (defined below), which is owned and operated by Togeth૪ing Media Labs Pvt. Ltd (“Company”). The Platform is an integrated online platform consisting of the “Togeth૪ing®” Application (“App”) which provides a two-way synchronous / simultaneous, real -time collaboration of multiple activities along with the media experience at the website “www.togethring.net” (together referred to as the “Platform”).
The terms “we”, “our” and “us” refers to the Company and its affiliates; and the terms “you”, “your” or the “User” refers to you, the users having access to, downloading, accessing, or duly registered with a profile on the Platform. Users may create their own profiles on the Platform, namely, a “t-café” profile.
“Services” shall mean the real time two- way synchronous /simultaneous collaboration listening, viewing of audio, video and photos, documents and content which is shoppable and bookable along with real time messaging internet calling services and other services to users around the world provided on the Platform.
We respect the privacy of everyone who visits/uses the Platform. This privacy policy (“Privacy Policy”) describes the procedures for collecting, using, and disclosing your Personal Information (defined below) which you provide to us to avail the Services or access the Platform. We recommend that you read this Privacy Policy so that you understand our approach towards the use of your Personal Information.
By providing us your Personal Information, and by accessing or using the Platform, you agree to our Privacy Policy, and you consent to our collection, storage, transfer, processing use, disclosure and other uses of your Personal Information as described in this Privacy Policy. You are providing the information out of your free will. You have the option not to provide us the Personal Information sought to be collected if you do not agree with this Policy. Further, you will have the option to not provide your consent, or withdraw any consent given earlier, provided that the decision to not provide consent / withdrawal of the consent is intimated to us in writing. When you register for an account, we collect certain Personal Information from you. You agree and understand that, we may collect and store the following information in relation to the Services:
The Personal Information we collect includes but is not limited to: your mobile number and e mail address, information related to the User profile, personally identifiable information, financial and payment information, authentication information, phonebook, contacts, microphone, camera, and other sensitive device or usage data as elaborated in this Privacy Policy (“Personal Information”).
The User profile created shall consist of name, pictures, music and videos, documents. All this information shall be used to create “t-Café profile” of the User. You also agree to provide us information relating to, your mobile address book on a regular basis. We do not allow unauthorized publishing or disclosure of non-public contact details. Further, during your access and use of the Platform, we may learn and collect additional information from and about you which may become part of the Personal Information. You allow us to access details of Your email accounts as well details received through registrations using Facebook and Google accounts, such details and information will be used to access your account when and for the limited purposes of using the Services of the Platform.
You agree and understand that, we also collect information when you log-in to our Platform or use our Services, which shall include but not limited to, photos, location of a photo/media, audios, videos, messages, status, chats, calls, photos or other information through the upload, sync or import. This can include information in or about the content you provide, such as the location of a photo/media or the date a file was created. We also collect information about how you use our Services, such as the types of content you view or engage with or the frequency and duration of your activities.
We also collect the Personal Information when other users upload, import or exchange your photos, audios, videos, messages, contact information and or any other Personal Information belonging to you.
We also collect the Personal Information with respect to your communication with other Users or the respective group in which you are a member. The Personal Information you exchange with other users and with the group members, who are connected through the Platform is collected by us.
We may collect Personal Information in form of details and documents you post in certain space on the profile, which is in public domain. The messages you send to us, and correspondence we receive from other user or third parties about your activities or postings on our Platform is also collected as Personal Information.
We may retain your invitations/messages in the ordinary course of providing our Services to you. The invitations and messages (including your chats, photos, videos, audio files, call logs, not conversations) delivered are saved on our servers for future use. An invitation/ message unaccepted or undelivered after 60 days is deleted.
We avail services of certain online partners to help us manage and optimize our business and communications. Our partners help us to delivering and understanding the effectiveness of our advertising and how the users use our Platform. We collect service-related diagnostic and performance information. This includes information about User activity log files, and diagnostic, crash, website and performance logs and reports.
When you use, or access the Platform, we may also collect and store additional information which may or may not personally identify you or be identifiable with other information collected. Such information includes, without limitation, your device specific information when you install access or use our Services, your hardware model, operating system information, browser information, internet protocol address, device identifiers your usage and log information, information about your status in relation to our show / chat room services, browser types, domain name, device locations, and other data involving your use of the Platform and/or our Services. We also collect information about your online and statues message changes on our Services. This information is collected passively using various technologies or may be provided by you through communications with us.
You give your express consent towards the usage of your Personal Information which is collected, stored and used by us for the limited purpose of directly providing and improving the features of the Platform and the Services. You also agree and understand that, the collection, use, and sharing of the Personal Information, shall be limited for the purpose of providing Services to you.

We may collect, disclose, process and transfer your Personal Information to: (i) provide the Services; (ii) create and administer the User accounts; (iii) improve our Services, the quality and your experience of the Platform and Services, including but not limited to conducting audits and resolving your issues; (iv) to analyze service related diagnostic and performance information; (v) providing information of events conducted in the local areas, as per location information; (vi) manage our relationship with you and develop our present and future Services; (v) maintain and update our records; and (vi) monitor suspected fraud, misconduct and unlawful activities and safety and security on the Platform. We will not sell, exchange or disclose your information with any third party without your consent, except as provided for in this Policy. We may also collect Personal Information when you interact with our customer service in order to assist you and to improve the operation of the Platform and the Services we offer.
In the event, you participate in any interactive features of the Platform, participate in a survey, contest, promotion, sweepstakes, activity or event, request customer support, communicate with us via third party social media sites or otherwise communicate with us, we collect the data you submit for such participation, which may also include Personal Information. We would use such data, as per the terms of this Privacy Policy.
You agree that we may also use the Personal Information to contact you and deliver information to you that, in some cases, are targeted to your interests, such as targeted advertisements, service offerings and communications relevant to your use of the Platform.

Personal Information exchanged with Public:
As a default setting, the Personal Information you exchange is only exchanged with or displayed for the Users with whom you have connected or with whom you interact through the Platform. However, in the event you chose to exchange the Personal Information with public at large e.g. Where you upload certain content on t-café, your Personal Information shall be displayed on the Platform and shall be visible to any and all users or visitors of the Platform. In the event, you choose to exchange your Personal Information with public, it shall be available to anyone who has availed or not availed our Services and can be seen or accessed through online search engines or offline media.
Information exchanged with other Users:
Your Personal Information may be exchanged, re-exchanged, uploaded or displayed by the other users (“Disclosing User”), in such an event the Users connected to such Disclosing User or the audience which such Disclosing User chooses, will have access to your Personal Information. In the event, you exchange Personal Information in any group of which you are part of, all the group members of such group shall have access to your Personal Information.
Service Providers:
We exchange your Personal Information with Service Providers who are listed, integrated or engaged with the Platform or the Company to offer their services to you. As part of their services, these Service Provider may exchange your Personal Information with the Users of their choice.
Affiliates:
We may provide Personal Information we collect, to our affiliates. For example, we may disclose Personal Information to our affiliates in order to respond to your requests for information or Services.
Joint Marketing Arrangements:

Our Platform may use “cookies” to enhance User experience. Cookies are small encrypted files, that the App transfers to your computer’s hard drive or on your mobile / tablet device or through any such device through which you may access the web through Your web browser that enables the Application to recognize your browser and capture and remember certain information.

We will retain your Personal Information for as long as your account is active or until the time we are required to provide you the Services. We may retain and use your Personal Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Consistent with these requirements, we will try to delete your information, upon reasonable request. Please note, however, that there might be latency in deleting information from our servers and backed-up versions. In addition, we do not delete from our servers’ files that you have in common with other users.

User’s Personal Information is stored on Amazon Web Servers which is a cloud infrastructure service offered By Amazon Web Services USA, and shall be exclusively responsible for protecting and securing the User’s Personal Information.
Although we provide appropriate firewalls and protections, we cannot warrant the security of any Personal Information transmitted as our systems are not hack proof. Data pilferage due to unauthorized hacking, virus attacks, technical issues is possible, and we take no liability or responsibility for it. Users are required to be careful to avoid “phishing” scams, where someone may send the User an e-mail that looks like it is from the Company asking for Personal Information. Company shall not be liable for any data hacked, destroyed or lost.
We also offer end-to-end encryption for our Services, which is on by default, when you and the other users avail our Services. End-to-end encryption means that your messages are encrypted to protect against us and third parties from reading them. We verify accounts and activity and promote safety and security on and off our Services, such as by investigating suspicious activity or violations of our Terms, and to ensure our Services are being used legally.
As a matter of security, we take back-up of systems periodically. Although we provide appropriate firewalls and protections. Our systems are not hack proof. Data pilferage due to unauthorized hacking, virus attacks, technical issues is possible, and we take no liabilities or responsibilities for it.
You are solely responsible for all actions of your user account and password. Therefore, we do not recommend that you disclose your password to any third party. If you choose to exchange your user account and password or any Personal Information with third parties, you are solely responsible for the same. If you lose control of your password, you may lose substantial control over your Personal Information and may be subject to legally binding actions.
The Platform does not use any malware code that could put a User, User’s data or device at risk. Our Malware policy is simple, the Android ecosystem including the Google Play Store.
8. ACCESSING AND MODIFYING PERSONAL INFORMATION
In case you need to access, review, and/or make changes to the Personal Information that you have provided to us, you may do so by logging in into your User Account. You may change your contact number, photos, status messages your name etc. You can make changes in your t-Café profile at any time by accessing the App settings. You understand that the Company shall not verify or authenticate the changes made to the Personal Information made by you and therefore you take entire responsibility of such changes. You confirm that such changes shall be in accordance with the terms and conditions of this Privacy Policy.
9. THIRD PARTY LINKS
We may have links to other websites / apps on the Platform, or you may be referred to our Platform through a link from another website /apps. We shall not be responsible for the privacy policies and practices of such websites / apps / platforms, and such content is subject to their terms of use and any additional guidelines and privacy information provided in relation to that use on their website / apps / platforms. If you use our Services with such third- party links, we may receive information about you.
We recommend that you check the policy of each website / app / platform you visit to better understand your rights and obligations especially when you are submitting any type of content on those third-party websites.
